◆ Terms of service ◆

Agreement

  • By commissioning me you are agreeing to my TOS. So make sure you read it carefully to avoid any confusion.

  • I will not be held responsible if there are any misunderstandings due to not reading my TOS thoroughly.

  • I reserve the right to refuse any order.

  • I reserve the right to use the commissioned artwork in my portfolio for promotional purposes.

  • I reserve the right to share WIPs and video processes of the commissioned art on my social media to promote my work and showcase my skills.

  • I reserve the right to stream the progress of commissioned work on my channels such as Twitch or YouTube.

  • If you request the commission to be kept private, an additional fee of 25% of the total commission price will be charged. This is because limiting my ability to showcase my work on social media may result in missed opportunities for potential customers to see my work.

  • All preparation materials, visuals, sketches, and electronic files used in the creation of the project remain the property of me, the artist.

  • The commissioned work cannot be used for any blockchain-related purposes such as NFTs, cryptocurrency, and other similar technologies.

  • All commissioned work cannot be used for AI/machine learning training purposes.

  • Plagiarism or claim the artwork as your own is strictly prohibited.

Timeline Process

  • Once the client has read and agreed to the TOS. The client may reach out via email ( [email protected] )for any inquiries. While initial contact through social media DMs is acceptable, once we've decided to collaborate, all further discussions will take place via email. After I read through the commission details, I'll provide a price estimate based on your requirements.

  • Once we have confirmed the price, schedule, deadline, and other details of the commission, you will be required to make a down payment of 50% of the full price within 3 days to secure your spot (I will send you a PayPal invoice for payment). I will begin working on your commission as soon as the payment is received.

  • The work process is typically divided into three steps: 1. Sketch 2. Lineart and blocking color 3. Rendering and finalizing.

  • I will confirm with the client before moving on to each step, and 2 revisions are allowed for each step for any changes the client wishes to make. Any additional revisions may incur an additional fee.

  • During the revision stage, it is highly recommended to gather all feedback and send it to me in one go, as making small changes repeatedly can be time-consuming and may cause delays in completing the commission.

  • Once the commission work is completed, I will inform the client and send an invoice for the remaining 50% of the down payment. The client is required to complete the full payment before receiving the commission file. The file will not be sent until full payment is received.

  • Please note that I require a minimum of 3 weeks to complete each commission. If the client requires the work to be done sooner, a rush work request can be made. Rush work requests will incur an additional fee of 30-60% of the total commission price, depending on how urgently the work is needed.

  • Please communicate via Email or Discord, as commission details will not be discussed through social media platforms such as Twitter or Instagram DMs.

Payment

  • Accept payment in USD currency only, with PayPal being the preferred payment method.

  • Clients in the USA can also use Zelle to make payments.

  • As mentioned earlier in the Timeline Process part, the client will need to pay a 50% deposit within 3 days to confirm your spot. If the deposit isn't received within 3 days, you'll lose your reserved spot.

  • For a big project such as VTuber Model, I do offer the option for clients to pay in installments. However, it's important for the client to discuss their payment plan with me beforehand. This includes the number of payments and the complete schedule of when those payments will be made.

  • Once the payment plan has been established, I will work on the client's commission according to their agreed payment schedule. It is important that the client adheres to the payment plan, as any missed payments or delays can result in a delay in the commission's completion.

  • In the event that the client is unable to complete their payment plan, I will work with them to find a solution that is fair for both parties. However, if an agreement cannot be reached, I reserve the right to cancel the commission and retain any work that has already been completed.

Refund and Cancellation Policy

  • A full refund can only be issued if the work has not yet started.

  • Refunds will not be allowed once the project has started.

  • If the client cancels a commission, your commission slot will be lost permanently.

  • If a client wishes to cancel a commission, any work that has already been completed by the artist will remain the property of the artist, and the client will not have the right to use, distribute, or claim the work as their own.

  • กรุณาอ่านกฏและข้อตกลงในการสั่งงานคอมมิชชั่นของนักวาดให้เรียบร้อย ก่อนที่จะสั่งงาน เพื่อป้องกันการเข้าใจผิดกันระหว่างตัวลูกค้าและนักวาดในอนาคต ลูกค้าที่สั่งงานคอมมิชชั่นกับทางเราถือว่ายอมรับและตกลงกับเงื่อนไขทุกอย่างตามที่ระบุไว้

  • หากมีข้อผิดพลาดที่สาเหตุเกิดจาลูกค้าอ่านกฏและข้อตกลงไม่ครบถ้วน ทางนักวาดจะไม่มีส่วนรับผิดชอบใดๆทั้งสิ้น

  • นักวาดมีสิทธิ์ปฏิเสธงานในกรณีที่รายละเอียดงานไม่ตรงกับสไตล์หรือความถนัดของนักวาด

  • นักวาดมีสิทธิ์ใช้รูปวาดคอมิชชั่นใน portfolio ของนักวาด

  • นักวาดมีสิทธิ์โพสภาพ WIP หรือ เบื้องหลังการสร้างผลงาน ลงบน social mediaต่างๆของนักวาด เพื่อใช้โปรโมท

  • นักวาดมีสิทธิ์สตรีมวาดรูปคอมมิชชั่นบนสตรีมมิ่งแพลตฟอร์ม เช่น YouTube หรือ Twitch

  • หากทางลูกค้ามีความประสงค์ที่จะไม่เผยแพร่งานคอมมิชชั่น เก็บงานเป็นความลับ ทางลูกค้าจำเป็นต้องเสียค่าใช้จ่ายเพิ่ม คิดเป็น 25% จากราคาเต็มของคอมมิชชั่น เนื่องด้วยทำให้นักวาดขาดโอกาสที่จะแสดงความสามารถและผลงานตนเอง

  • รูปสเก็ตและไฟล์งานทั้งหมดที่ใช้สร้างสรรค์ตัวงานไฟนอลถือเป็นกรรมมสิทธิ์ของนักวาด

  • ไม่อนุญาตให้นำงานคอมมิชชั่นไปใช้ใน NFTs, cryptocurrency หรือเทคโนโลยีที่คล้ายคลึงกัน ในทุกกรณี

  • ไม่อนุญาตให้นำงานคอมมิชชั่นไปใช้สำหรับการฝึก AI ในทุกกรณี

  • ห้ามแอบอ้างว่าเป็นเจ้าของผลงานโดยเด็ดขาด

ขั้นตอนการทำงาน

  • หลังจากที่ลูกค้าอ่านTOS ทั้งหมดและยอมรับในกฏและข้อตกลงแล้ว ลูกค้าสามารถติดต่องานผ่าน e-mail: [email protected] สามารถติดต่องานเบื้องต้นผ่านช่องทางโซเชี่ยลมีเดียได้ แต่เมื่อตกลงร่วมงานกันแล้ว การคุยงานที่เหลือกรุณาติดต่อผ่านทาง e-mail

  • เมื่อตกลงราคา เดธไลน์ และตารางงานได้แล้ว ลูกค้าจะต้องชำระเงินเป็นจำนวณ 50% ของราคาเต็มภายในระยะเวลา 3 วัน เพื่อเป็นการคอนเฟิร์มคิวงาน นักวาดจะเริ่มงานทันทีหลังจากได้รับเงินครึ่งแรก

  • ขั้นตอนการทำงานของนักวาดจะแบ่งเป็น 3 ขั้นใหญ่ๆ 1. สเก็ต 2. ตัดเส้นลงสี 3. เรนเดอร์และเก็บงาน

  • ทุกๆขั้นตอนจะมีการส่งให้ลูกค้าดูก่อนเพื่อคอนเฟิร์มก่อนจะทำงานขั้นต่อไป

  • ลูกค้ามีโควต้าขอแก้งานได้ 2 ครั้งในแต่ละขั้น หากต้องการแก้เพิ่มนอกเหนือจากโควต้าที่มีให้ จะมีการคิดค่าแก้เพิ่ม

  • การขอแก้งานนั้น แนะนำให้ลูกค้ารวบรวมรายละเอียดและจุดที่อยากจะแก้ทั้งหมด และส่งมาให้นักวาดในคราวเดียวกัน พยายามหลีกเลี่ยงการค่อยๆทยอยส่งจุดที่อยากจะแก้มาให้นักวาด เนื่องจากการทยอยส่ง feedback ทำให้กินเวลาในการทำงานและอาจส่งผลต่อเดธไลน์ได้

  • เมื่องานคอมมิชชั่นเสร็จแล้ว ทางนักวาดจะติดต่อลูกค้าไปเพื่อแจ้งให้ทราบ ลูกค้าสามารถชำระเงินส่วนที่เหลือได้ทันที นักวาดจะส่งไฟล์งานให้หลังจากได้รับเงินเต็มจำนวณแล้วเท่านั้น

  • นักวาดต้องการเวลาอย่างน้อย 3 อาทิตย์ในการทำงานคอมมิชชั่นทุกๆงาน ลูกค้าสามารถของานเร่งได้หากต้องการให้งานเสร็จเร็วกว่านั้น ทั้งนี้ทั้งนั้นจะมีการคิดค่าเร่งงานเพิ่ม โดยจะคิดเป็น 30-60% ของราคาเต็ม ขึ้นอยู่กับว่าลูกค้าต้องการงานเร็วแค่ไหน

  • ใช้ E-mail หรือ Discord ในการติดต่อคุยงานเป็นหลัก ทางนักวาดไม่สะดวกติดต่อคุยรายละเอียดงานผ่าน social media

การชำระค่าใช้จ่าย

  • ช่องทางการโอนเงินมี Paypal (รับสกุลเงิน USD เท่านั้น)

  • สำหรับลูกค้าคนไทย สามารถชำระเงินผ่านบัญชีไทยได้

  • อย่างที่ได้กล่าวไปในช่วง ขั้นตอนการทำงาน ว่าลูกค้าจะต้องชำระเงิน 50% ของราคาเต็มภายในระยะเวลา 3 วัน เพื่อเป็นการคอนเฟิร์มคิวงาน หากไม่สามารถชำระเงินได้ภายใน 3 วัน จะถือว่าลูกค้ายกเลิกคิวงานกับทางนักวาดทันที

  • สำหรับโปรเจคใหญ่ที่มีราคาสูงเช่นโมเดลวีทูปเบอร์ ทางนักวาดยินยอมหากลูกค้าต้องการแบ่งจ่ายเป็นงวด ทั้งนี้ทั้งนั้นลูกค้าจำเป็นต้องพูดคุยและวางแผนการแบ่งจ่ายกับทางนักวาดให้เรียบร้อยก่อน

  • เมื่อตกลงตารางการแบ่งจ่ายกับนักวาดเรียบร้อยแล้ว นักวาดจะทำงานให้สอดคล้องกับตารางการแบ่งจ่าย

  • หากมีสถานการณ์ที่ทางลูกค้าไม่สามารถชำระเงินได้ทุกงวดให้สมบูรณ์ได้ จะต้องมีการเจรจาเพื่อแก้ไขและหาทางออกที่เท่าเทียมที่สุดสำหรับทั้งนักวาดและลูกค้า หากการเจรจาไม่สามรถหาข้อสรุปได้ ทางนักวาดมีสิทธิ์ในการยกเลิกงานคอมมิชชั่นและรักษาสิทธิ์ในทุกๆไฟล์งานที่นักวาดได้ทำเสร็จไปแล้ว

การคืนเงินและยกเลิก

  • หากต้องการเลิกว่าจ้าง ทางลูกค้าต้องแจ้งยกเลิกงานก่อนที่นักวาดจะเริ่มวาดงาน จึงจะสามารถได้ค่ามัดจำคืนเต็มจำนวณ

  • จะไม่มีการคืนเงิน หากนักวาดได้เริ่มวาดงานคอมมิชชั่นไปแล้ว

  • หากลูกค้าต้องการยกเลิกว่าจ้าง ไฟล์งานใดๆ ที่นักวาดได้ทำเสร็จแล้วจะยังคงเป็นทรัพย์สินของนักวาด และลูกค้าจะไม่มีสิทธิ์ใช้ แจกจ่าย หรืออ้างสิทธิ์ในผลงานเป็นของตนเอง

If the client's design includes extra parts or features that are not listed on the chart. The client can discuss it with me in detail to come up with a price estimate that reflects the additional complexity.

Design Fee

I offer character design services for clients who do not have a design for their Vtuber model at a rate of $300.

It's important to note that this service only includes the front view of the model, and is not the same as a full character sheet.
Please keep in mind that this price may change in the future.

Vtuber Model Term of Service

1.) The price for Vtuber model commission includes commercial use.

  • The client can use the Vtuber model for streaming on all streaming platforms.

  • The client can use images and designs of the model to produce goods and merchandise.

2.) I offer free model edits for better rigging quality as requested by the rigger.

  • I will not draw any additional parts that were not agreed upon in the initial commission agreement.

  • I am willing to communicate with the rigger directly to ensure a smooth workflow. I can communicate fluently in Thai and have moderate proficiency in English.

3.) The client can choose to credit or not credit me for drawing the model, However, it is important to note that the client cannot claim to be the creator of the model.4.) The Vtuber model files are exclusively for use by Vtubers and content creators.5.) I am not permitted to use any layer or image from the Vtuber model files for reproduction or distribution purposes.6.) The client is not allowed to use the body base of the model to create new models or resale.7.) The files are not permitted to be used in NFTs.8.) The client is not allowed to make any edits or modifications to the model without first consulting with me.9.) If the client wishes to commission additional parts or props for their model, they may contact me directly.10.) I do not allow any unauthorized modifications or additions to the commissioned model, including any alterations made by the client or any third-party artist without my prior consent.11.) Please inform me first, If the client wants to sell the model to someone else. I reserve the right to refuse if the person the client wants to sell the model to is on my blacklist.12.) A VTuber model art typically takes a minimum of 1-2 months to complete, and I do not accept rush work.13.) If the client wishes to cancel the project after it has already begun, all project files will remain in my ownership as the artist. The client cannot request to purchase any of the files used in the project.

Workflow

1.) After the client provides me with their character design and specifications, I will provide a final quote for the project base on the client's specifications.2.) Upon agreement of the final price, a 50% deposit is required from the client within 3 days.3.) If the client wishes to make installment payments, the first payment must be at least 25% of the final price and must be made within 3 days as well.4.) Once I receive the first payment, I will begin sketching the model.5.) I will send the sketch to the client for feedback once it is finished. The client is allowed up to 2 revisions to provide feedback. Any additional revisions beyond that will incur an additional cost of $50.6.) Once the sketch has been approved by the client, I will proceed to do the lineart, coloring, and rendering.7.) After I finish rendering the model, I will send it back to the client for their feedback. They will have 2 rounds of revisions, just as before. Any additional revisions requested beyond that will result in an additional cost of $50.8.) Once the model has been approved by the client, I will prepare the files by separating parts and making them ready to be rigged by the rigger.9.) I will notify the client as soon as I finish separating the model parts. In the meantime, the client can complete the full payment before receiving the completed files.10.) I will only deliver the completed files to the client once I have received the full payment. Upon completion of payment, my part in creating the Vtuber model will be considered complete.11.) As previously mentioned, I am willing to make any necessary edits that the rigger may require in order to improve the quality of the rigging.

Payment

1.) The payment terms require a 50% down payment before the project gets started, followed by the remaining 50% when the project is completed.
2.) To pay in installments, the client must discuss a payment plan with me before starting the project.

  • The payment plan should be completed within the timeframe of creating the model, which is usually 1-2 months.

  • The first payment must be at least 25% of the total price.

  • If the client is unable to complete the payment in time, an additional month may be granted. However, I will not send the file to the client until I have received the full payment.

3.) If the client cancels the commission after I have already started working on it, the down payment will not be refunded.

กฏและข้อตกลงในการสั่งคมช. โมเดลวีทูปเบอร์

1.) ราคาโมเดลวีทูปที่เสนอ เป็นราคาที่รวมการใช้เชิงพาณิชย์แล้ว โดยสิทธิ์ที่ลูกค้ามีในการใช้เชิงพาณิชย์ได้แก่

  • สามารถใช้โมเดลในการไลฟ์สตรีมเพื่อหารายได้ในทุกแพลตฟอร์ม

  • สามารถใช้ดีไซน์/รูปโมเดลเต็มตัว ในการทำสินค้าหรือผลิตภัณท์ขายได้

2.) เมื่อริกเกอร์นำไฟล์โมเดลไปริกแล้วเจอจุดที่อยากให้แก้เพื่อคุณภาพของงานริกที่ดีขึ้น ทางนักวาดยินดีแก้ไขตามคำขอของริกเกอร์ให้ฟรีตลอดจนจบโปรเจค

  • ทั้งนี้ทั้งนั้นจุดที่ให้แก้หรือวาดเพิ่มจะต้องเป็นจุดเห็นสมควรว่าจำเป็นต้องปรับปรุงเพื่อที่ริกเกอร์จะสามารถริกได้สวยขึ้นจริงๆแล้วเท่านั้น

  • จะไม่มีการวาดชิ้นส่วนหรือพาร์ทที่ไม่ได้ตกลงกันไว้ก่อนเพิ่ม

  • นักวาดยินดีประสานงานกับริกเกอร์โดยตรง หากเป็นความต้องการของตัวริกเกอร์ เพื่อการสื่อสารที่คล่องตัวขึ้น ทางนักวาดพอจะมีความรู้เรื่องการริกอยู่บ้าง จึงยินดีที่จะคุยกับริกเกอร์โดนตรงหากริกเกอร์ต้องการ ภาษาที่นักวาดใช้สื่อสารได้ มี ภาษาอังกฤษและไทย

3.) การให้เครดิตนักวาด (mama ของ Vtuber) สามารถใช้ชื่อ Raveeoftitans ในการให้เครดิตได้ และตัวนักวาดยินดีหากลูกค้าไม่ประสงค์จะไม่ระบุชื่อนักวาด แต่ลูกค้าจะต้องไม่แอบอ้างว่าเป็นผู้วาดหรือผู้ออกแบบเอง4.) ไฟล์โมเดลวีทูป ไม่สามารถนำไปทำอย่างอื่นได้นอกจาก ใช้ทำ Vtuber/Content Creator5.) ไม่อนุญาติให้แยกชิ้นส่วนโมเดลและนำไปขายต่อหรือทำเพิ่มเป็นอันเด็ดขาด6.) ไม่อนุญาติให้นำเบสโมเดล/บอร์ดี้ ไปสร้างเป็นโมเดล/ตัวละครใหม่ได้7.) ไม่อนุญาติให้นำไฟล์งานทั้งหมด ไปทำเป็น NFT ขายโดยเด็ดขาด8.) ไม่สามารถปรับ/แก้/เพิ่มบนไฟล์โมเดลวีทูปด้วยตนเอง หากไม่ได้รับการยินยอมจากนักวาดก่อน หากมีจุดประสงค์ที่อยากจะแก้บางส่วนด้วยตนเองจริงๆ กรุณาติดต่อสอบถามกับนักวาดก่อน9.) ในกรณีที่ลูกค้าต้องการเพิ่ม ชุดใหม่ / ทรงผมใหม่ / พร๊อบใหม่ และอื่นๆ

  • สามารถติดต่อโดยตรงกับนักวาดที่เป็นคนวาดตัวโมเดล ยินดีรับงานต่อเนื่องจากลูกค้าเก่า

  • ไม่อนุญาติให้นักวาดท่านอื่นวาดแทน โดยไม่มีการตกลงก่อน

  • ห้ามมีการนำไฟล์โมเดล ไปใช้เป็นเบสในการทำ ชุดใหม่ / ทรงผมใหม่ / พร๊อบใหม่ เพิ่ม ด้วยตนเอง หรือนักวาดท่านอื่น โดยไม่ได้รับการยินยอมจากนักวาดที่เป็นคนวาดตัวโมเดลก่อน เป็นอันเด็ดขาด

10.) หากต้องการขาย/ส่งต่อโมเดลให้กับบุคคลอื่น ต้องมีการแจ้ง/ทำข้อตกลงกับทางนักวาดก่อน ทางนักวาดมีสิทธิ์ปฏิเสธการขาย/ส่งต่อโมเดลให้กับบุคคลที่อยู่ใน Backlist ของนักวาด

11.) โมเดลวีทูปอย่างเดียวใช้เวลาอย่างน้อย 1-2 เดือนในการทำ ไม่รับงานเร่งในทุกกรณี12.) กรณีที่ต้องการยกเลิกงานกลางทาง สิทธิ์ในไฟล์งานทั้งหมดจะอยู่กับทางนักวาดแต่เพียงผู้เดียว ไม่สามารถต่อรองขอแบ่งซื้อได้

ขั้นตอนการทำงาน

1.) ลูกค้าส่งดีไซน์ตัวละครมาให้นักวาดดูและบอกความต้องการให้นักวาดรับทราบว่ามีอะไรบ้าง เพื่อให้นักวาดสามารถตีราคาและเสนอกลับไปให้ลูกค้าพิจารณา2.) เมื่อลูกค้าตกลงกับราคาแล้ว ลูกค้าต้องชำระเงินครึ่งแรกภายใน 3 วัน หรือหากลูกค้าที่ต้องการแบ่งจ่าย สามารถจ่ายงวดแรก โดยงวดแรกจะต้องไม่ต่ำกว่า 25% ของราคาเต็ม ภายใน 3 วันเช่นกัน3.) เมื่อได้รับเงินแล้ว ทางนักวาดจะเริ่มสเก็ตตัวโมเดลให้
เมื่อสเก็ตเสร็จแล้ว ทางนักวาดจะส่งให้ลูกค้าดู โดยลูกค้าจะมีโควต้าขอแก้ได้ 2 ครั้ง หากต้องแก้มากกว่าที่มีโควต้าให้ จะมีค่าแก้ครั้งละ 1,500 บาท4.) เมื่อสเก็ตผ่านแล้ว นักวาดจะเริ่มวาดโมเดล ทั้งตัดเส้นและลงสีให้เรียบร้อย
หลังโมเดลเสร็จ ทางนักวาดจะส่งให้ลูกค้าดูอีกครั้ง โดยครั้งนี้ก็จะมีโควต้าขอแก้ได้อีก 2 ครั้งเช่นกัน และเหมือนเดิมว่าหากต้องการแก้มากกว่าที่มีโควต้าให้ จะมีค่าแก้ครั้งละ 1,500 บาท5.) เมื่อลูกค้าให้ผ่าน ทางนักวาดก็จะนำโมเดลไปแยกพาร์ทให้เรียบร้อย เตรียมไฟล์สำหรับริกเกอร์6.) เมื่อลูกค้าชำระเงินที่เหลือเสร็จครบตามจำนวน ทางนักวาดก็จะส่งไฟล์ .psd และ .png ของโมเดลให้ เป็นอันสิ้นสุดการวาดโมเดลวีทูป7.) อย่างที่กล่าวไปใน ข้อตกลงเกี่ยวกับการใช้เงิน ว่าทางนักวาดยินดีแก้ไฟล์งานให้ หากริกเกอร์พบจุดที่ต้องการให้แก้8.) กระบวนกาทำงานทั้งหมดจะอยู่ในระยะ 1-2 เดือนโดยประมาณ

การชำระเงิน

1.) ลูกค้าต้องชำระเงินครึ่งแรกก่อนงานเริ่มและครึ่งหลังเมื่องานเสร็จ ไฟล์งานจะถูกส่งให้เมื่อได้รับเงินเต็มจำนวณแล้วเท่านั้น2.) นักวาดรับการแบ่งจายเป็นงวด ในกรณีที่ต้องการแบ่งจ่ายเป็นงวดๆ ลูกค้าสามารถขอแบ่งจ่ายเป็นงวดได้ตามที่ลูกค้าสะดวก แต่ต้องสามารถจ่ายได้ครบภายในระยะเวลาในการทำงาน (1-2 เดือน)

  • ในกรณีแบ่งจ่ายหลายงวด งวดแรกสุดจะต้องไม่ต่ำกว่า 25% ของราคาเต็ม

  • หากมีเหตุที่ไม่สามารถชำระเงินได้ตามกำหนด สามารถอนุโลม เลื่อนระยะเวลาจ่ายไปให้ได้อีก 1 เดือน แต่จะไม่มีการส่งไฟล์เต็มให้จนกว่าลูกค้าจะจ่ายครบเต็มจำนวณเงิน

3.) หากมีการยกเลิกงานกลางคัน โดยที่ทางนักวาดได้เริ่มทำงานชิ้นนั้นของลูกค้าไปในระดับหนึ่งแล้ว จะไม่มีการคืนเงินมัดจำและเงินที่โอนมาแล้วในทุกกรณี
